A Johnson County man’s case which alleges the rape of a juvenile of less than 14 years of age was set for a trial date in Johnson County Circuit Court Friday.

Following an indictment in July of 2018, Marvin P. Martin, 34, of Thelma, appeared in Johnson County Circuit Court today for a final report in his case, with his defense stating that he would like to have a jury trial.

Johnson County Circuit Judge John Preston accepted his request, setting a trial date for Oct. 23.

Martin is alleged, in his indictment, to have committed the offense of second-degree rape by “knowingly and unlawfully … engaging in sexual intercourse with a person less than 14 years of age,” second-degree sodomy by “knowingly and unlawfully … engaging in deviate sexual intercourse with a person less than 14 years of age,” and second-degree sexual abuse by “knowingly and unlawfully … subjecting a person less than 14 years of age … to sexual contact” between 2017 and (2018).”

Martin was arrested in July 2018, and has remained lodged in the Big Sandy Regional Detention Center since.
