A Paintsville man was arrested on several traffic charges after a traffic stop led to the discovery of an allegedly intoxicated driver and seven individuals in a pickup truck, two of whom were minors.

The citation said Paintsville Police Department Officer Zach Mitchell observed the vehicle traveling on FM Stafford Avenue toward Ky. 321 and could not see a seatbelt on the driver. Mitchell said that, after the vehicle passed him, he observed tail lights not functioning properly and that the tailgate of the truck was taped shut. Mitchell said he also observed what appeared to be two individuals in the bed of the truck.

Mitchell said the driver then turned the vehicle off of Ky. 321 and onto Lower Street, where Mitchell performed a traffic stop, according to the citation, before observing the driver of the vehicle, Daniel Wade Hall, 19, of Paintsville, appeared to be intoxicated, with “glassy and bloodshot eyes,” and dilated pupils that did not respond to a light source. Mitchell also said Hall appeared to be very nervous and was behaving erratically, according to the citation.

According to the citation, Mitchell asked Hall if there was anything inside the vehicle and Hall consented for Officer Zach Stapleton to search the vehicle, which was occupied by seven individuals, two of whom were under 18 years of age and all of whom were under 21.

The search led to the discovery of three bottles of “hard liquor,” and a grinder with a green leafy substance with a “strong odor,” which Mitchell said was marijuana.

Hall was unable to successfully complete field sobriety tests and was arrested, according to the citation. The citation said a breathalyzer test performed on Hall did not indicate the presence of alcohol, although Hall advised Mitchell he had “smoked marijuana approximately three hours prior to contact (with Mitchell).”

The citation said the other four adults were released and the two minors were sent with custodial guardians, while Hall was transported to Paul B. Hall Regional Medical Center for a blood test, which was still pending results at the time of the citation, according to the citation.

Hall was lodged in the Big Sandy Regional Detention Center on charges of first-offense DUI, possession of an open alcoholic beverage container in a motor vehicle, possession of marijuana and traffic charges, where he was released the following day. Hall is set to be arraigned Sep. 23.
